Fairfax police captain files defamation suit against chief

The Fairfax County police captain in charge of major investigations has filed a defamation lawsuit against Chief David M. Rohrer for e-mails he sent this past spring criticizing the captain and for other actions Rohrer took in response to an anonymous letter alleging internal corruption.
Capt. Denise L. Hopson, 42, oversees the major crimes division of the Fairfax police, including the homicide, robbery and sex crimes detective squads. For a sitting police commander to sue her chief is extremely unusual. Hopson’s attorney, Victor M. Glasberg, advised her not to comment, but he said Hopson did not take the step into court lightly.

“It’s very rough,” Glasberg said. “Denise is in the very rough and uncomfortable position of having to sue her chief and wishes she wasn’t there. She is a loyal and dedicated Fairfax cop. She understands and respects the chain of command, and her professional obligations, and she will abide by them.”
Rohrer and other Fairfax police officials did not immediately respond to a request for comment. The county typically does not discuss pending litigation, police spokeswoman Mary Ann Jennings said.
The chain of events was set off by an anonymous letter that was sent to Rohrer on Jan. 6 and also sent to The Washington Post. The letter claimed to be from “a group of Fairfax County Police Officers who are outraged about the recent process used to select future detectives for the Major Crimes Division.”
Hopson had recently revised the promotion process, her lawsuit says, because the prior system was thought to be unfair. Hopson’s process, including a new written essay requirement, received praise from her commanders, according to the suit.
But the anonymous letter alleged that Hopson manipulated the process to allow a friend to make the list of “highly qualified” candidates for promotion to detective while excluding others with better résumés. In January, lower-level supervisors promoted two officers from the new list to the detective bureau.
Rohrer referred the anonymous letter to internal affairs. Hopson cooperated with the investigation, provided documentation to explain how the process had worked and believed she would soon be cleared, her lawsuit says.
In March, Rohrer decided to invalidate the process and return those already promoted to their previous jobs and said he would transfer Hopson to the police training academy, the chief announced at a command staff meeting, according to the lawsuit and sources familiar with the case. Hopson ultimately was allowed to stay in her job.
On March 7, the chief sent an e-mail to senior commanders saying that the “selection process was unfair and flawed” and that he was going to address it in an e-mail to the entire department. Rohrer added that “the problems primarily center on flawed/poor judgment on the part of the commander running the process.”
Later that day, Rohrer sent a department-wide e-mail announcing the invalidation of the process and the demotion of the two detectives as a result of “clearly a flawed process from a fundamental fairness perspective.”
The internal affairs investigation was still in progress. Hopson alleges in the suit that Rohrer was “willing to take unconsidered, premature and excessive action” toward her because she once complained that he had failed to order a thorough investigation into a male supervisor’s alleged sexual harassment of a female officer.
“Chief Rohrer has never forgiven Capt. Hopson for her challenge to his authority and decision in that case,” the suit says.
Hopson’s suit, filed in Fairfax County Circuit Court, indicates that she also might sue a deputy chief, Maggie DeBoard, because she thinks DeBoard urged Rohrer to act quickly on the anonymous complaint even though the internal affairs investigation was still underway.
In April, the internal affairs probe concluded that the allegations were “not sustained,” the suit says. But Rohrer has declined to sign that finding, the suit alleges.

A New York police commander who pepper-sprayed protesters during the opening days of the Occupy Wall Street demonstrations last month faces an internal disciplinary charge that could cost him 10 vacation days, the police said Tuesday.       

The commander, Deputy Inspector Anthony Bologna, has been given a so-called command discipline, according to a law enforcement official. Officials said investigators found that the inspector ran afoul of Police Department rules for the use of the spray. The department’s patrol guide, its policy manual, says pepper spray should be used primarily to control a suspect who is resisting arrest, or for protection; it does allow for its use in “disorder control,” but only by officers with special training.
The Internal Affairs Bureau reviewed the episode and found that Inspector Bologna “used pepper spray outside departmental guidelines,” said Paul J. Browne, the Police Department’s chief spokesman. He declined to elaborate.
The inspector can accept the charge and plead guilty, or he can opt for a departmental trial. Police Commissioner Raymond W. Kelly is the ultimate arbiter of punishment in such matters and has wide leeway in his decisions.
Inspector Bologna’s actions on Sept. 24, when he sprayed several penned-in women, were captured on video and spread widely on the Internet. It became a defining moment in the protests.
Four days later, Mr. Kelly said the Internal Affairs Bureau would look into the inspector’s actions. At the same time, the Manhattan district attorney’s office opened an investigation. On Monday, one woman who was pepper-sprayed, accompanied by her lawyer, met with prosecutors and urged them to bring criminal charges against the inspector.
Mr. Browne could not immediately say where the commander is now assigned. But Deputy Inspector Roy T. Richter, the head of the Captains Endowment Association, said he was still assigned to the same command.
“Deputy Inspector Bologna is disappointed at the results of the department investigation,” Inspector Richter said. “His actions prevented further injury and escalation of tumultuous conduct. To date, this conduct has not been portrayed in its true context.”
On Tuesday afternoon, a few hundred people marched to the offices of the Manhattan district attorney, Cyrus R. Vance, Jr., calling for him to drop criminal charges against people arrested during the protests.
After leaving the district attorney’s office, about 200 people marched to Skylight Studios on Hudson Street, where Gov. Andrew M. Cuomo received an award from the Huffington Post. The protestors said they wanted the governor to support retention of the so-called millionaire tax.
The feminist author Naomi Wolf, who was among the group, was handcuffed and received a summons for blocking pedestrian traffic, the police said.

The national police problem

In Helena, Arkansas, five Helena-West Helena police officers were arrested Tuesday as part of a major drug trafficking crackdown that also involved public corruption. More than 800 federal and local police took part in mass arrests that targeted 70 people on federal charges. The police action, code named Operation Delta Blues, targeted crack cocaine sale and money laundering, but also swept up the Helena-West Helena police on corruption charges. The officers arrested are Helena-West Helena Police Department officer Herman Eaton, 46; Helena-West Helena officer Robert “Bam Bam” Rogers, 35; Helena-West Helena Sgt. Marlene Kalb, 48; Marvell police officer Robert Wahls, 42; and former Phillips County Deputy Sheriff Winston Dean Jackson, 44, who’s now a Helena-West Helena police officer. They face a variety of drug trafficking and other charges.

In Caruthersville, Missouri, the Caruthersville police chief and an officer were arrested October 6 and charged with forgery and theft. Chief Chris Riggs and Officer Marcus Hopkins each face multiple counts of forgery, while Riggs also faces one count of theft. Their exact misdeeds have not been revealed, but the investigation was conducted by the Missouri Highway Patrol Drugs and Crime Division. Both men are free on $200,000 bonds. Riggs remains police chief.

In Bayou La Batre, Alabama, a former Bayou La Batre police officer was arrested October 7 after a months-long investigation into missing drug money by the Alabama Bureau of Investigation. Former officer Jason Edwards had been in charge of confiscated drug money when some turned up missing in March. He resigned over the summer. At last report, Edwards was out on bail pending trial.

In St. Martinsville, Louisiana, a St. Martin Parish Sheriff’s Office jail guard was arrested October 5 for allegedly smuggling contraband into the St. Martin Parish Correctional II Facility. Officer Freddie Abraham, 20, is charged with malfeasance in office, criminal conspiracy, attempted introduction of contraband in penal institutions, and possession with intent to distribute marijuana. He was last reported in jail trying to make a $30,000 bond.

In Blacksburg, South Carolina, a former Cherokee County sheriff’s department narcotics officer was arrested October 5 for engaging in sex acts with a confidential informant who had pending charges. Albert Phillips, 41, is charged with misconduct in office for the acts, which took place between December 2008 and January 2009. He resigned in January 2009.

In Petaluma, California, a guard at San Quentin state prison was arrested October 6 for selling drugs at the prison and accepting bribes. Robert Alioto, 48, was booked on suspicion of requesting or receiving a bribe, possession of marijuana for sale, sales or transportation of marijuana, conspiracy and selling drugs to a person in custody. Officials had few details. Alioto is free on $50,000 bail.

New York NY police tactics are being questioned after a video shows a mounted officer apparently spurring his horse into a crowd of trapped OccupyWallStreet protesters who were so packed together that they had nowhere to go. 2 Detroit MI cops are the subject of a lawsuit alleging excessive force at a casino, the third such case involving police at that casino in fact. 9th Circuit Court also ruled similarly in a case involving Maui HI police who tasered a woman while she was trying to calm her husband down during a confrontation between him and the cops who were responding to a domestic complaint. A Southaven MS police lieutenant and 6 other officers are the subject of a lawsuit alleging they forced a family out of their home at gunpoint after they received but didn’t properly investigate a questionable burglary tip from a caller who based his suspicion on seeing a garage door opened. San Diego CA police officer in the above video used some questionable tactics on Occupy San Diego protesters by apparently applying a choke hold to at least one protester then spraying several others, including the person taking the video. New York NY police in this video above make some highly questionable arrests outside and inside a Citibank branch where Occupy Wall Street protesters were trying to close their accounts. The really questionable one is where a woman, claiming to be a customer, is grabbed by a man in plain clothes then dragged inside to be arrested. This is really disturbing because the official statement is that the people arrested at that incident were charged with trespassing for refusing to go outside when the manager told them to.
