Fairfax police Capt. Denise Hopson settles lawsuit against Chief David Rohrer
The Fairfax County police captain who sued her own police chief for defamation, after the chief sent out e-mails that the captain said insulted her, has settled the lawsuit for more than $35,000 and a promise not to transfer her out of the high-profile major crimes division for a minimum of 18 months.
Capt. Denise L. Hopson was upset by actions taken by Fairfax Chief David M. Rohrer during an investigation of the promotional process for detectives, which was overseen and revamped by Hopson. After an anonymous complaint about Hopson was received, but before an investigation was completed, Rohrer in March of last year ordered the results of her new process thrown out and those promoted returned to their prior jobs. The chief sent an e-mail to top commanders that called the process “unfair and flawed.”
The chief’s e-mail stated, “the problems primarily center on flawed/poor judgment on the part of the commander running the process.” A second, department-wide e-mail from Rohrer described the testing as “clearly a flawed process from a fundamental fairness perspective.”
In her lawsuit, Hopson alleged that Rohrer was retaliating against her “for her challenge to his authority and decision” in an unrelated sexual harassment case.
As part of the settlement, neither side was allowed to comment beyond another e-mail written by Rohrer, to be sent to the entire Fairfax department. He said that the investigation into the allegations of unfairness had been completed and that Hopson had committed no violations.
But “my decision to vacate the process was affirmed by the inquiry,” Rohrer wrote. He said the investigation found a “lack of a standard protocol for lateral selection processes.” A county personnel director will develop new promotional processes, Rohrer said, which Hopson will oversee.
Hopson thought that she was about to be transferred out of the major crimes division, which includes the homicide, robbery, sex crimes and financial crimes squads, as a result of the anonymous allegations and resulting uproar. But according to the settlement released Thursday, she will remain in her captain’s post for a minimum of 18 more months. In the settlement, Rohrer denied a potential transfer or any retaliation against her.
The financial settlement of $36,097 covers the legal fees of her attorney, Victor M. Glasberg. Neither he nor a police spokeswoman would comment, in accordance with the terms of the case settlement.

Fairfax County is reintroducing its "Most Wanted" fugitives site, debuting the redesign this week with updated information and photos of alleged criminals, cute little bunnies and guys in skimpy shorts.
"Basically we had two sites that we were keeping up," explained FCPD spokeswoman Lucy Caldwell. "We had a 'Top 10' like, you know, the Beatles and Elvis and like that and a 'Most Wanted,' like, you know, a vacation in a really nice place, like, say you know, Baltimore or something.
Police decide who to feature based on a variety of factors, including sexiness and clarity of the photo. At the moment, the county has 3,800 people who are "wanted."

If the Police Stop You...
• Stay in control of your emotions and words. Don’t physically resist.
• Keep your hands visible.
• Remain silent. They have guns, pepper spray and billy clubs. Your strongest weapon is your mind.
• The less you say, the better. Silence is not a crime.
• Ask, "Am I free to go?" If they keep you, you are being detained.
• Ask, "Why are you detaining me?" To detain you, the police must have reasonable suspicion that a person has been involved in criminal activity.
or Try to Search You...
• Never consent to a search.
• Say loud and clear (especially if there are any witnesses present): "I do not consent to a search."
• Don’t resist physically.
• Don’t open your bag for them. It will count as consent to the search.
• Police may 'pat down' your clothing if they suspect weapons or drugs.
or Try to Enter Your Home...
• Never consent to a search.
• Step outside. Lock the door behind you.
• Ask to see a warrant. Make sure it has the right information (e.g., address) and a judge’s signature.
• They can do only what the warrant allows them to. Warrants often limit the search to one room, one day, etc. Make sure they are complying with the warrant.

• When they ask you, show them your driver’s license, registration, and proof of insurance.

• If they give you a ticket, sign it. Otherwise you can be arrested. Fight the ticket in court later.
• If the police suspect you of drunk driving and you refuse to take a blood, urine or breath test, your license can be suspended.
If the Police Arrest You...

• The police may handcuff, search, photograph and fingerprint you.
• Do not talk about your case to anyone except your attorney.

OPINION
STEPHEN R. McCULLOUGH, Judge.
David H. Dailey ("husband") contends that the trial court erred in holding that his retirement, and the share of that retirement that is being disbursed to his former wife, Janice M. Dailey ("wife"), did not constitute a basis to modify the husband's spousal support obligation to wife. We agree with husband and, therefore, reverse and remand.
BACKGROUND
Husband and wife were divorced in 2009. The final decree of divorce, dated September 14, 2009, incorporated the parties' property settlement agreement. The agreement provides that husband must pay wife $1,000 per month in spousal support "to continue . . . until such time as the Wife's remarriage, or cohabitation with another person in a relationship analogous to marriage for a period of one year, or Wife's death, or Husband's death, whichever first occurs. The support provided for herein shall be modifiable upon a material change in circumstances . . . ." The agreement further specifies, with respect to husband's retirement, that wife "shall receive fifty percent (50%) of the marital share of the Husband's gross retirement pay if as and when received by the Husband." At the time of the divorce, husband was working for the Fairfax County Police Department. He had worked there for 29-and-a-half years. The Fairfax County retirement plan in question does not contain a survivor benefit for an ex-wife when the divorce occurs prior to retirement. Husband testified that at the time of the entry of the divorce decree, husband had no plans to retire.
On November 19, 2010, husband retired from the Fairfax County Police Department and obtained employment as a Deputy Sheriff in Loudoun County. As a consequence, wife began to receive both the spousal support and her share of husband's retirement pension. Prior to retirement, wife received $1,000 per month from husband in spousal support. Following husband's retirement, wife received a combined spousal support and pension share of approximately $3,900 per month.
Husband filed a motion to terminate or reduce wife's spousal support. He contended that his retirement, and wife's receipt of her share of his retirement pension, constituted a material change in circumstances. Wife agreed that a change in circumstances had occurred, but resisted any modification of support, contending that the parties had contemplated the change at the time they entered into their agreement. Following a hearing, the trial court noted that the parties agreed that a material change in circumstances had occurred. The court proceeded to consider the factors found in Code § 20-107.1(E)(1). After reviewing the factors, the court concluded that no modification of spousal support was warranted because paying both spousal support and a share of retirement was exactly what the parties had "bargained for." Husband appeals from this decision.
