Fairfax Police Chief: Video Cameras Make Review Board Unnecessary

Yeah, like the cops won't get around that one............the verbal abuse (of course the cops didn't torment and verbally dress down Michael Kennedy, we all know that right. The records on that incident are still stamped secret by the cops and, trust me, they always will be) or the beatings inside the McLean station (Yeah, we know about that one)  


 April 04, 2011 - In Virginia, members of the Fairfax County Board of Supervisors are considering a proposal to create a panel of citizens that would be able to conduct investigations of police misconduct. But the chief of police and the county executive are strongly opposed to the idea.

Police Chief David Rohrer and County Executive Anthony Griffin say one of the reason citizens don't need to be involved in oversight is the anticipated installation of cameras in police cruisers.

"The very fact that the citizens know that the encounters are being videotaped is a way to reassure the public that they have some measure of protection or proof of what happened," says police spokesperson Mary Ann Jennings.
But Fairfax County has a history of withholding basic information from the public, including video footage of an officer firing a fatal shot at an unarmed driver.
"Cameras in police cruisers are good ideas if there's a protocol that requires that they be on all the time and they are available to the public. But even then, it is not a substitute for a citizen review board," says Kent Willis of the American Civil Liberties Union of Virginia.

The cameras would cost $3.7 million, and police won't say when -- or if -- the footage will ever be public.

The Board of Supervisors delayed action on a proposal to increase oversight of the Fairfax County Police Department on Tuesday, instead sending the proposal to the Public Safety Committee.

Under the proposal from County Executive Anthony Griffin, citizens who felt unsatisfied with a police investigation of a complaint about an officer or an officer-involved shooting could petition Griffin for a separate investigation by the county's Internal Audit Office.
Currently, most complaints and officer-involved shootings are only investigated internally by FCPD.
“I don’t believe that we have achieved consensus," Supervisor Gerald Hyland (D-Mount Vernon), the chairman of the Public Safety Committee, said, adding that he expected the board to eventually reach agreement.
Sending the proposal to the Public Safety Commitee would allow for more input from citizens and give the supervisors another chance to hear from FCPD Chief David Rohrer, according to Hyland. The board accepted his proposal unanimously.
The drive to provide other avenues for investigation into FCPD comes in the wake of several controversial shootings by FCPD officers, including the January 2006 shooting death of an unarmed man in Fair Oaks and the November 2009 shooting of an unarmed, bipolar man in Fort Hunt.
Nicholas Beltrante, a Mount Vernon resident and former homicide detective in Washington's Metropolitan Police Department, thought there was something wrong with the FCPD internal investigations of the shootings.
"There have been a number of shooting deaths of Fairfax County citizens which I did not feel were justified," he said.
In April 2010, he formed the Virginia Citizens Association for Police Accountability, which advocates for FCPD incidents to be investigated by a review board that includes county residents with no connection to the government, rather than the Internal Audit Office.
On Wednesday, Beltrante criticized how the Board of Supervisors is handling the investigation process.
“There is no citizen participation in the process,” he said. Beltrante said his group will now send letters to each supervisor asking for a meeting, although he says previous requests for a meeting with Hyland have gone unanswered.

Surveillance Video Is Shown at Rape Trial of 2 Officers

They flashed across the gray screen for just a matter of seconds.
The woman briskly bounds toward a door, making a brief half-turn and gesturing to the police officer just behind her. A few steps back, another officer follows.
This was the surveillance footage that captured Officers Kenneth Moreno and Franklin Mata accompanying a woman into her East Village apartment, an encounter that would lead to her accusation that Officer Moreno had raped her while she was drunk, while Officer Mata served as a lookout.
The clip was played publicly for the first time on Thursday during the second day of testimony in the trial of the two officers in State Supreme Court in Manhattan. It captures the first of four visits the officers made to the woman’s apartment early on the morning of Dec. 7, 2008, after she left a party at a Park Slope bar held to celebrate her job promotion. The other visits were also captured on video, taken from a security camera outside a bar adjacent to the woman’s apartment building.
For the prosecution, the video establishes that the officers, for whatever reason, visited the woman’s apartment several times that morning. But the defense will use the woman’s appearance on the tape to suggest that she was not as intoxicated as the prosecution claims, since she appears to be walking on her own. That argument was bolstered by Andom Mangum, a 35-year old teacher, who testified that as he was leaving the building that morning, the officers were escorting the woman in, and that she walked up the stairs under her own power.
A friend, Joanna Kreling, testified that later that day, the distraught woman confided to her that she believed she had been raped by a police officer.
“She was extremely broken down and just emotional and crying,” Ms. Kreling said.
Ms. Kreling and two other friends accompanied the woman to Beth Israel Medical Center, where she received a rape kit. They decided to report what had happened to the district attorney’s office rather than call the police, Ms. Kreling said.
The woman continued to appear “devastated” at the hospital, Ms. Kreling said.
The woman “is a very vivacious, energetic person and, um,” Ms. Kreling said, her eyes watering and her face turning red, “she was not that person.”
But under cross-examination, Ms. Kreling revealed that the woman, while at the hospital, said, “I can’t believe he left me like that.”
The defense plans to argue that it would have made no sense for the woman to make that comment about someone who had raped her.
The officers are accused of rape, falsifying records, official misconduct, burglary and other crimes.
Officer Moreno’s lawyers have argued that their client established a rapport with the woman when he escorted her upstairs. He returned to the woman’s apartment at her request, and he kissed her on the shoulder, but they did not have sex, they say.

Citizens will have no role in a model for investigating allegations of police misconduct under a recommendation presented to the Fairfax County Board of Supervisors this week by Police Chief David Rohrer and County Executive Anthony Griffin. For advocates of a citizen review board, the move was a disappointing rejection of an effort more than a year in the making. Almost immediately after a memorandum outlining the plan was released last week, experts began questioning the extent of research that was invested in the proposal.

"I find it perplexing that they made no effort to contact the National Association for Civilian Oversight of Law Enforcement," said Phillip Eure, former president of that organization, adding that he’s still waiting to receive a phone call from Fairfax County. "It really makes you wonder about the extent of the best-practices research they conducted."

The March 29 memorandum outlining the plan does include a 1997 report indicating that only 98 out of 651 eligible agencies had public review. But critics of the proposal say much has changed in the last 14 years, and that if the county officials had examined the current state of the field they would have discovered that Fairfax County is the largest jurisdiction in the country without any independent review of its police department.

"It’s unfortunate that the board is seeking guidance from Chief Rohrer because I feel he’s a big part of the problem," said Ronald Koch, president of the Citizens Coalition for Police Accountability. "He would much prefer to continue to have police police themselves."

INSTEAD OF HAVING an independent investigation of allegations of police misconduct, Rohrer and Griffin suggest having the county auditor review the police investigation. The brief memorandum outlining how this would work explains that the auditor, who reports to the county executive, would not have the power to subpoena witnesses. Instead, the auditor’s review would be limited to examining the police investigation.

"It is not proposed that the Internal Auditor will do an independent investigation separate from the police," Rohrer and Griffin write in the March 29 memorandum. "There may be instances, however, when the Internal Auditor will need to contract for consultants to aid in a view to compensate for a lack of particularized expertise in a specific area."

Critics say this model presents a conflict of interest. Because the auditor and the chief of police report to the same individual, how would the public ever know if the two disagreed on an investigation? Also, would an employee of the county executive be willing to issue a report detailing police misconduct? Advocates for a citizen oversight panel say the only way to ensure an independent investigation is to create a system outside of the existing power structure.

"It’s clear that they are doing everything in their power to avoid citizen oversight," said Nicholas Beltrante, executive director of the Citizens Coalition for Police Accountability. "I would encourage the Board of Supervisors to adopt our proposal rather than the one presented by the chief of police and county executive."

ALTHOUGH THE PROPOSAL from Rohrer and Griffin was on the docket for the Board of Supervisors meeting this week, Mount Vernon Supervisor Gerry Hyland offered a motion to postpone the matter and send it to the Public Safety Committee and the Citizen Advisory Committee. The move was cheered by many who were concerned that the public had no opportunity to respond to the proposal. Now that the police chief and county executive are on record opposing citizen oversight, those who would like to see a more public process say they will be fighting for a more public process than the one currently under consideration.

"Having an auditor review the police investigation is like having the fox guarding the hen-house," said Kent Willis, executive director of the American Civil Liberties Union of Virginia. "Citizens should have the opportunity to evaluate, investigate and review police activity."

Rohrer and Griffin, on the other hand, believe that a citizen review board would not provide "additional value" to a review process. In the memorandum outlining their proposal, they say the citizen’s role would stop at asking for an investigation. Because the auditor already investigates allegations of inappropriate behavior and business practices, they say, he or she would be familiar with police procedure and investigator practices.

"There is no strong evidence that a citizen review board provides additional value to a review process," they wrote. "Public review boards have the same issues as any publicly appointed body."

THE MOVEMENT TO CREATE a citizen review board in Fairfax County began in February 2010, shortly after police officer David Ziants shot and killed an unarmed driver on Richmond Highway. Police officials failed to release the incident report or the dashboard video footage of the incident, even when the information was requested in a Virginia Freedom of Information Act request. Yet Rohrer and Griffin now say the existence of the dashboard video footage is a reason citizen input is not needed.

"In summary, an independent auditor is a recognized model and option to provide an independent look at significant responses by police and alleged police misconduct," the memorandum concludes. "It allows the public to initiate reviews of the Police Department actions, and coupled with the Board’s anticipated acquisition and installation of digital cameras in police patrol vehicles, which the Police Department has long sought, the public’s trust of police should be enhanced."

The Fairfax County Police Department has long maintained the position that its incident reports should be kept secret, even though these documents are routinely available in the vast majority of jurisdictions across the country. Even when one of their officers shot and killed the unarmed man in 2009, the department refused to identify the officer who fired the fatal shot.

"What does the name of an officer give the public in terms of information and disclosure?" asked police spokeswoman Mary Ann Jennings at the time. "I’d be curious to know why they want the name of an officer."
Because the auditor would merely review information submitted by police, critics say, the department’s reputation of secrecy would be counterproductive for investigating allegations of misconduct.

"We’re happy they’ve acknowledged there’s a problem," said Koch. "But the proposal currently under consideration is not what we were looking for."

Fairfax County executive proposes letting internal auditor oversee police conduct probes

Fairfax County’s top administrator is proposing that the county’s internal auditor — rather than a committee of residents — review citizen appeals questioning the outcome of police misconduct investigations

The recommendation comes after a citizens’ group, formed after county officers killed two motorists, requested a more independent process that involved civilians.


Residents led by a retired D.C. police detective formed the Virginia Citizens Coalition for Police Accountability last year after two incidents on Route 1. In 2008, a teacher’s assistant died in a police crash; in 2009, an officer fatally shot unarmed motorist David Masters.

When a resident or fellow officer accuses a Fairfax officer of wrongdoing, the complaint is investigated by the police department’s internal affairs unit and resolved by the chief. Deemed personnel matters, the results of the investigations are rarely made public.

The citizens’ group, which found that Fairfax was the largest jurisdiction in the country without an independent citizen review board, recommended the creation of an oversight panel that includes county residents.

The coalition took its case to the Fairfax Board of Supervisors, which asked Police Chief David M. Rohrer and County Executive Anthony H. Griffin to look into the matter. After doing so, Griffin decided against a review involving citizens.


Instead, in a “board item” Griffin will discuss at a supervisors’ meeting Tuesday, Griffin proposes using the county’s internal auditor, Christopher Pietsch, who investigates citizen complaints about fraud and ethics in county government.

If complainants are dissatisfied with the police investigation, Griffin said, they could appeal to the auditor. He would review the police investigation and report to the county executive.

Griffin noted that the auditor already works with the police department on his investigations and is familiar with its procedures. He also noted that Pietsch reports to the county executive, “thus satisfying the independent third party review requirement.”

Griffin’s memo to the board cited a 1997 study of police review boards and said there were four models for review of police conduct: three involving citizens and one using an ”independent auditor.” He said there was “no strong evidence that a citizen review board provides additional value to a review process.”

Rohrer and the police officers’ union support the idea, Griffin’s memo said.

Rohrer did not want to discuss the idea until it was officially proposed on Tuesday. Griffin and union head Michael Scanlon did not answer requests for comment.

The citizens’ coalition was not happy with the proposal. Nicholas Beltrante, the group’s founder, called Griffin’s idea “a step in the right direction,” but also said “it falls short of the [coalition’s] recommendation for a citizens’ review board that would be comprised of Fairfax County citizens.”

Philip K. Eure, executive director of the civilian-run D.C. Office of Police Complaints, also helps run the National Association for Civilian Oversight of Law Enforcement. He called it “puzzling” that Fairfax never contacted the association for information on how a civilian review board might work.

Eure also noted that “since both the police chief and the internal auditor report to the same person, the county executive, questions could legitimately be raised about the auditor’s independence to offer frank assessments of problems within the police department.”

This doesn’t include a case earlier this year of an officer under investigation for shooting at a fleeing vehicle after a chase was called off when police found out there was an infant inside of it. And finally, I was undecided about adding this report at first until some more recent details about what happened came out. Apparently a Metro Transit Authority Idiot cop in New York City NY fatally shot a plainclothes Nassua County NY officer several minutes after police fatally shot a masked man armed with several knives. Reports so far say the officer, who lives near the shooting scene, is distraught about what happened and opened fire when he saw the officer walking towards the scene with a rifle at his side shortly after he arrived to investigate what was happening. Certainly a sad mistake, but the accounts are reading as if the officer didn’t announce himself or give the other officer a sufficient chance to disarm before firing. We’ve seen an increase in friendly fire fatalities in our research so far and are left wondering if the focus on officer safety above all else is so intense that it’s now putting other officers at risk along with the general public. McKean County PA apparently kept a $30,000 settlement secret since June of last year. The settlement was made to a WWII veteran who was 86-years-old when he was roughly arrested by the McKean County sheriff in an incident that was captured on video and ended up on YouTube.
