Cop watch

A Utah State Trooper repeatedly punched a 53-year-old woman in a car after a police chase has received a lot of play in the news. The trooper is now on paid leave while under investigation over the incident which occurred almost five months ago and the trooper claims he was using “distraction blows” because the woman refused to get out and was still trying to drive away after her car was blocked in and he was too close to use a taser.

A New York NY cop claims he accidentally shot an apparently unarmed 76-year-old man who was the father of the subject of a search warrant during a drug raid at a Queens apartment building, though there haven’t been any details released describing exactly how it was an accidental shooting.

A US Border Patrol agent is the subject of a lawsuit over the fatal cross-border shooting of a 15-year-old boy who was on the Mexican side of the border when he was shot. Border Patrol officials have claimed that the boy was among a group of teens who were throwing rocks at agents as justification for the deadly shooting but at least one alleged 3rd-party witness has contradicted that claim.

Four Lake Station IN cops are the subject of a lawsuit by a man claiming they used excessive force when they broke both of his arms during an arrest… To be honest I’m a bit on the fence about adding this one due to the absence of any details here and may remove it if more information comes out contradicting his claim. If anyone hears more about this one let me know.

An unknown number of Uniontown PA cops are accused of needlessly shooting a family’s dog seven times, six of which with handguns and once with a shotgun, after the owner of the dog called police to report a prowler that the dog apparently chased off.

At least two West Virginia State cops are being sued by a 63-year-old man and his wife who claim that the officers used excessive force on both of them while serving a warrant for the man’s arrest. They claim officers beat the husband on multiple occasions before and after arrest while they also dragged his wheelchair-bound wife across the ground, injuring her too. However, he also claims officers used anti-Semitic slurs against him during the beatings and some of the claims seem a bit questionable even for the problematic WV police. Police claim he was armed with a screwdriver or knife and had barricaded himself in the home and that his wife attacked and clawed at them, which also seems a stretch… It seems likely the truth is somewhere in between the two claims, but seemingly excessive anyway given the pair’s ages and condition.

A North Carolina trooper is still the subject of a criminal investigation eight months after he allegedly detained a woman without explanation in his cruiser during a traffic stop and exposed himself to her before releasing her without charge. The officer resigned after he was notified about the investigation about a month after the incident but details of the incident have only now gone public.

Details about how Chicago IL police arrested a woman for recording internal affairs officers she claims refused to take her complaint about an officer who allegedly raped her because she had violated that state’s wiretap laws by doing so came out this weekend in a report about that state’s laws that make it a felony to record the police. We recorded the passage of that law last year along with another case that will hopefully test that law. Both of the people we’ve tracked so far arrested over that law face up to 15 years in prison for it. While some may not think this is misconduct since it’s perfectly legal for the officers to arrest the woman based on that state’s laws, we do feel that the law in that state is a very serious threat to police accountability and transparency and how police apply that law in cases where it appears they are avoiding accountability by doing so should be tracked.

A Detroit MI cop is accused of refusing to help two women who struggled to detain a car burglar that they detained and tried to take back to the police station after the Detroit police never sent a unit out when they called. Apparently the officer, that the woman spotted while dragging the man in, refused to even get out of his car then took off after a college campus cop stopped to assist. The chief of police insists he’s looking into it.

Cleveland OH police detectives are accused of violating departmental rules and federal laws by improperly clearing 52 rape cases as closed without ever even identifying any suspects in those cases, just to make their case closure statistics look better than they were.

The now-former sheriff of Ramsey County MN is accused of lying when he claimed there were 33 active terrorist organizations in that county. The current sheriff is making the allegations after he tried to locate the studies and reports those claims were allegedly based on and, found nothing at all. It’s being claimed that the sheriff made up the information to secure funding for his anti-terrorism task force which was allegedly nothing more than some highly-paid officers sitting around searching the net and spying on groups such as PETA and the CUAPB (Communities United Against Police Brutality).

A Des Moines IA police lieutenant is on paid leave while he’s the subject of an unspecified investigation being conducted by a regional drug task force.

A Palatka FL cop has resigned after he was arrested on drunk driving charges with a .15BAC when he blew out the tires on his police cruiser after hitting several curbs.

A Washington County WV sheriff’s captain has resigned and filed for retirement benefits after he was placed on leave when medication was found to be missing from the jail where he was assigned as administrator and he was allegedly the only one with access to that medication.

Independence MO police supervisors were ruled to have misled the police chief and manufactured a case against a police sergeant in order to retaliate against him for voicing his concerns about staffing levels.

The sheriff of Osceola County IA is being sued by a former deputy who claims he was wrongfully fired in violation of his First Amendment rights for offering to testify in a civil case against the sheriff’s office in a case where a man was denied a gun permit because of his political views, which was also ruled a fist amendment violation.

The Seattle WA police union is in the news over articles in their newsletter, especially one that criticizes the city’s anti-profiling and anti-discrimination efforts in which city officials are called “the enemy”.

Local Residents Hold Dialogue with FCPD’s

                                                                         Ima Goniff

Residents from Reston and Herndon had the opportunity to talk to and ask questions of Fairfax County Police Department spokesman, Ima Goniff, Thursday evening.

Goniff was the guest speaker at the January meeting of the Reston district station's Citizens Advisory Committee, which is another huge waste of money because the police control the Committees; otherwise, a whole lot of people would be out of job right now.

“The diversity is an exceptional thing in Fairfax,” he said, adding that having such a diverse population brings unique challenges to the police department. “The coloreds run pretty fast, so gunshots work best with them, but then you got your Vietnamese’s-is, they’re so skinny Annie Oakly would miss a shot at them, so your baton works best in that case....like I say, its unique challenges, but really, we like killing unarmed white people the best”

He said about 120 or more languages are spoken in Fairfax County “And we don’t listen to a single one of em...its all fuck’n Greek to me” he said but added “But I think those Indians guys, not the real ones, the one’s eat rice, they speak kinda like English”

Diversity among the county’s police department is far lower than it should be, said the spokesman meaning that mostly white people work for the police. He said the department has a difficult time recruiting diverse candidates for many reasons, but mostly because they aren’t wanted on the force, which, at this point, resembles a republican central committee meeting in Alabama.

When the serial burglar case was going on in the late summer and early fall, Fairfax County police made its war on texting a top priority and spent a lot of time and resources on it, he said. The cops surrendered to text messages a few weeks after they declared war.

He said having a true cat burglar who goes into people’s homes while they sleep is very scary. “Like you known, a boogie man who takes things” Eventually one McLean resident called about a suspicious person in their neighborhood, and the dastardly Fairfax County serial burglar was arrested...by the Montgomery County Police. He said the case shows the importance in people calling the Montgomery County police when they notice suspicious happenings in their neighborhoods. “They get shit done over there,” he added.

During the case, he said they continued to remind area residents to lock their doors and secure their homes and garages. “We also reminded them that the Discovery Channel was running an excellent series on guys who can nail stuff into their feet, because, like, a lot of times, they don’t rerun those shows.”

The Fairfax County Police Department will have to start rethinking how it grows in the future, with Metro and related development coming “That Metro is going to bring a lot more diversity challenging types in here” and added that Tyson’s Corner will likely eventually have an urban police station model, where a station may be located in a high-rise building with shared parking. “Because that’s our answer to everything” he said, “Spend more, spend more, spend more and give us more stuff “

He said though he is concerned with increased crime that Metro may bring to the communities it is extended to with Dulles Rail, often that crime is small and occurs in the parking lots rather than the surrounding communities. “So I’m just gonna avoid parking lots” he said

He said that doesn’t mean crime doesn’t happen in communities where Metro stations are located, but that it usually happens in close proximity to the station which is saying the same thing but it makes sense if you aren’t listening to him or not paying attention “We get away with shit like that all the time”, he said.

Though many residents and area media are often concerned with violent crimes, he said the cop’s plans to continue to shoot people anyway especially those holding a cell phone because “We can’t help it....our car doors open by themselves and hit our arms and the guns just go off..and I got ten guys who willl swear to that”

He said his biggest concern in policing the county is domestic violence and alcohol-related offenses and is advising his officers to stop beating their wives when their drunk “That way, the whole crime stats things go down like 9 million percent” he said.

He added that driving under the influence is not always seen as a big deal and that he was happy about that becuase “Most of my guys are loaded half the time”

Teamwork: Fairfax County cop David Baucum and "Blast'n"Deval Bullock

Fairfax County police release photo of Fairfax County Cop David Baucum, who was invovled in the police killing of Sal Pulosi

Oh gosh, you know what? We were unable to get that photo but over the next ten years, several times a month, we're gonna work on bringing you a photo of  Mr. Baucum

From Reason magazine

http://reason.com/

Last week The Washington Post reported that Sal Culosi's parents have reached a $2 million settlement with Fairfax County, Virginia, police Detective Deval Bullock, who shot and killed the 38-year-old optometrist during a January 2006 SWAT raid on his home. The unusual settlement reflects the outrageous facts of this case, in which an unarmed man suspected of nothing more than betting on sports was recklessly gunned down during an unnecessarily violent operation.

The SWAT team came to Culosi's house because another Fairfax County detective, David Baucum, overheard him and some friends wagering on a college football game at a bar. "To Sal, betting a few bills on the Redskins was a stress reliever, done among friends," a friend of Culosi's told me shortly after his death. "None of us single, successful professionals ever thought that betting 50 bucks or so on the Virginia/Virginia Tech football game was a crime worthy of investigation." Baucum apparently did. After overhearing the wagering, Baucum befriended Culosi. During the next several months he talked Culosi into raising the stakes of what Culosi thought were friendly wagers. Eventually Culosi and Baucum bet more than $2,000 in a single day, enough under Virginia law for police to charge Culosi with running a gambling operation. That's when they brought in the SWAT team.

On the night of January 24, 2006, Baucum called Culosi and arranged a time to drop by to collect his winnings. When Culosi, barefoot and clad in a T-shirt and jeans, stepped out of his house to meet the man he thought was a friend, the SWAT team moved in. Moments later, Bullock, who had had been on duty since 4 a.m. and hadn't slept in 17 hours, killed him. Culosi's last words: "Dude, what are you doing?"

Culosi's parents, Sal and Anita Culosi, later learned that police stopped a nurse at Fairfax Hospital, where Culosi's body was taken after the raid, from notifying them that their son, one of three children, had been shot. (The optometrist's father is also named Salvatore, shortened to Sal, although the son was named after an uncle on his mother's side—ironically, a police officer who was killed in the line of duty.) The Culosis did not hear about the raid until five hours after their son had been shot and killed, preventing the devout Catholic family from administering last rites.

In the months that followed, Baucum continued his investigation, badgering Culosi's grieving friends and relatives after pulling their names and numbers from the cell phone he was carrying and a computer taken from his home the night he was killed. Steve Gulley, Culosi's brother-in-law, told The Washington Post the following April that Baucum called him and menacingly asked, "How much are you into Sal for?" Scott Lunceford, a lifelong friend of Culosi's, told the Post Baucum called him and accused him of being a gambler. The calls, Gulley told the paper, smacked of intimidation aimed at discouraging a lawsuit.

Police departments in Northern Virginia are notoriously stingy with information, and the Culosis grew increasingly frustrated with Fairfax County Police Chief David Rohrer. The public did not even learn Bullock's name until The Washington Post's Tom Jackman reported it based on a tip from a confidential source. (The Fairfax County Police Department still has not released the name of the police officer who shot unarmed motorist David Masters in November 2009.) It took more than a year for the police department to issue its report (PDF) on Culosi's death. The report, prepared by Chief Rohrer's staff, claimed Bullock accidentally fired his gun—resulting in a direct hit that pierced Culosi's heart—after the door to Bullock's SUV recoiled and struck him in the arm as he was getting out of the vehicle. The report did at least acknowledge that Bullock inappropriately had his finger on the trigger of his weapon. It also conceded that in hindsight sending a SWAT team after an unarmed man accused of a nonviolent crime probably was a mistake, although it did not fault the department for doing so.

The Culosis were dubious. They believed Bullock mistook the cell phone their son was holding the night he was shot for a gun. They hired their own investigators, who determined, based on the department's own measurements of the crime scene, that when Bullock pulled the trigger he was away from his vehicle and much closer to Culosi than he had claimed. Using the recorded locations of shell casings, police vehicles, and Culosi's body, they produced computer animations (see below) showing that the incident could not have happened in the manner described by Chief Rohrer's report.

Bullock was suspended for three weeks without pay, a paltry punishment given that he killed an unarmed man. Fairfax County Commonwealth's Attorney Robert Horan announced in March 2006 that he would not be filing criminal charges against Bullock. That was not surprising. Horan, who retired in 2008, had never brought criminal charges against a police officer in his 40 years on the job. Horan described the shooting as an accident. Yet the same month that Bullock killed Culosi, a 19-year-old man in neighboring Prince William County was charged with involuntary manslaughter after a gun he was showing to a friend accidentally discharged and killed the friend. And just a week before Horan cleared Bullock, a youth in Chesapeake, Virginia, was convicted on the same charge for accidentally firing a gun from the backseat of a car, killing the driver.

Bullock's colleagues on the police force nevertheless criticized what they called an excessively harsh punishment. Officer Marshall Thielen, president of the Fairfax County police officers union, told The Washington Post the punishment "may be politically motivated because of all the media attention." Union attorney Edward J. Nuttall told the paper that the suspension was "way off the charts" and that an oral or written reprimand would have been more appropriate.

Shortly after the release of Rohrer's report, Sal and Anita Culosi filed a federal lawsuit against Bullock, Rohrer, and Fairfax County, charging that Bullock had violated Culosi's civil rights and that Rohrer and Fairfax County were negligent in training and had implemented bad policies that resulted in Culosi's death. The courts eventually removed Rohrer and Fairfax County from the lawsuit—a tough blow because the Culosis told me one of their main goals was to change the way Fairfax County uses its SWAT team. They could not comprehend why an optometrist with no criminal record who was accused of gambling on football games would merit a SWAT team. According to Rohrer's report, 46 percent of all search warrants in the county are served with SWAT teams. (A department spokesperson said shortly after the shooting that SWAT teams were used to serve all of the county’s warrants.) The removal of Rohrer and Fairfax County from the suit left only Bullock, although all of his legal fees and any judgment against him would be paid by Fairfax County and therefore by taxpayers.

The same year Fairfax County taxpayers paid for the five-month-long investigation into Sal Culosi’s casual wagering, Virginia's government spent $20 million promoting the state lottery. In March 2006, two months after its ridiculous gambling investigation resulted in the death of an unarmed man, the Fairfax County Police Department issued a press release (no longer available on the department's website) warning residents not to participate in office betting pools tied to the NCAA men's basketball tournament. The title: "Illegal Gambling Not Worth the Risk."

In a heartbreaking entry on a website she set up for her son, Anita Culosi addressed him directly last week:

I'll beg your forgiveness Son…because I am not able…to go the distance. They call it…settlement. I call it something else…and because of that…my heart…is not settled…and my hope for justice…and my promise to you…have both been compromised...I believe in my heart that we would have won in court but I was told to consider the risk of that not happening...Our family has already been through almost 5 years of pain, frustration, disappointments, and stress...and there was the opinion that even if we won the county would appeal and that would mean a few more years and resources fighting what could still be a losing battle.

Anita Culosi's grief and disappointment are certainly understandable, but governments don't offer $2 million settlements every day. The offer came just as the trial was set to begin and just days after U.S. District Judge Leonie M. Brinkema ruled that the Culosis could show the computer animations produced by their investigators to the jury. While a jury verdict against Bullock might have given the Culosis the satisfaction of having fellow Fairfax County residents acknowledge the outrage done to their son, a $2 million settlement amounts to an admission of guilt, no matter how county officials try to spin it, because winning a lawsuit against a police officer is extremely difficult.

Shortly after Sal Culosi's death, his family started a blog in his memory called "Justice for Sal." After five years of battling stubborn public officials, an obfuscatory police bureaucracy, and a legal system designed to make it as difficult as possible to hold the government accountable, Sal and Anita Culosi should finally allow themselves to exhale. As much as anyone can in a case like this, they have found the justice they've been seeking.

.......several cops on the force were in hock to Culosi in big way.

We want to go on record as saying that not for one second do we believe the rumor that Sal Culosi was gunned down by the Fairfax County Police because several cops on the force were in hock to Culosi in big way. That would be murder and no one in this case was convicted of murder.

A Seattle WA cop is the subject of renewed calls for federal intervention into the department over an alleged off-duty road rage incident where the cop pulled his gun on a 19-year-old man. Part of the complaint made by two former US Attorneys are that at least one detective attempted to cover up for that cop by shopping for charges against his victim. Apparently the detective tried to convince county prosecutors to charge the man with assaulting ancop and, when they refused, he tried to convince the city attorney to file misdemeanor charges against the man, all while ignoring and hiding testimony from witnesses claiming that thecop was the aggressor. The department’s Office of Professional Accountability is also being implicated for not properly investigating the allegations during an internal review and the chief for using the resultant flawed investigation to keep records sealed.
